Police reported that Frank Lupinacci, 46, waited for his estranged wife, Marydell, to leave her apartment for work, confronted her, exchanged words with her and then shot her in the head with a hand gun. He then turned the gun on himself and later died.

Frank, a convicted felon, was legally prohibited from possessing a gun. Both Marydell and Lupinacci had petitioned for protective orders against each other.

On August 12, 2004, Marydell was granted a protective order against Lupinacci. His protection order petition was dismissed on July 19, 2004.
